Terms of Service

1. Who you are contracting with

Titan Business OS (“Titan”, “we”, “us”) is operated by Titan Build System (“the Company”). By creating an account, accessing, or using the service you (“you”, “the user”, or “your organization”, if you are signing up on behalf of a business) agree to these Terms of Service. If you are agreeing on behalf of an organization, you confirm you have the authority to bind that organization to these terms and are of legal age in your jurisdiction.

2. The service

Titan is a business operating system that includes tools for customer management, estimating, invoicing, project tracking, reporting, branding, team management, and AI-assisted operations (“Ask Titan”). Features and capabilities may change over time as the product evolves. We do not guarantee that the service will be uninterrupted, error-free, or continuously available.

3. Your account

• You must provide accurate information and keep it current.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must notify us promptly of any unauthorized access to your account.

4. Acceptable use

You agree not to:

• Use the service in violation of any law or regulation.
• Send spam, phishing, fraudulent messages, or malware through Titan.
• Infringe on any third party’s intellectual property, privacy, or other rights.
• Probe, scan, scrape, reverse-engineer, or otherwise attempt to circumvent the security or technical limitations of the service.
• Attempt to resell, sublicense, or redistribute the service without a written agreement with us.
• Use the service to generate or distribute illegal content, child sexual abuse material, deepfakes intended to deceive, hate speech, targeted harassment, or content that facilitates violence.

5. AI-assisted features (Ask Titan)

Titan includes AI-assisted features that generate recommendations, drafts, summaries, and other outputs (“AI Outputs”). By using these features you acknowledge:

• AI Outputs may be inaccurate, incomplete, or biased. You are responsible for reviewing them before acting on them.
• AI Outputs are not professional legal, financial, tax, medical, or engineering advice.
• You are responsible for your prompts, for having the rights to any content you input, and for how you use AI Outputs.
• We may apply reasonable fair-use limits to AI usage to prevent abuse and to keep the service available for all customers. If fair-use thresholds are introduced, we will give reasonable notice. We may throttle, warn, or temporarily suspend AI access for accounts showing patterns consistent with abuse or attempts to bypass limits.
• We reserve the right to remove, filter, or refuse AI Outputs that violate this section or our policies, and to suspend accounts that repeatedly generate such content.

6. Intellectual property

The Titan software, brand, documentation, and all underlying intellectual property remain the property of Titan Build System and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have subscribed to. You retain ownership of the business data you enter into Titan (“Your Content”), and grant us a limited license to host and process Your Content solely to provide and improve the service.

7. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics for your purchase are governed by Paddle’s Buyer Terms available at paddle.com/legal/checkout-buyer-terms. Subscriptions renew automatically at the interval you selected until cancelled. You can cancel or change your subscription at any time via the Billing page in Titan, which opens Paddle’s secure customer portal.

8. Downgrades and plan limits

If you downgrade to a plan with fewer included workspaces or seats, we will never delete your data. Excess workspaces and users will be preserved but marked read-only until you upgrade, purchase add-ons, or archive the excess yourself. You retain full read access to your data at all times.

9. Suspension and termination

We may suspend or terminate your access to the service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations of our acceptable use policy. If we terminate your account for cause, you will be given a reasonable window to export your data before deletion, subject to legal or security constraints.

10. Warranties and liability

To the fullest extent permitted by law, the service is provided on an “as-is” and “as-available” basis without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability to you for any claims arising out of or related to the service is limited to the fees paid by you in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including lost profits, lost data, or loss of goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or in-app notice at least 30 days before the change takes effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of the United States and the state in which Titan Build System is headquartered, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts of that jurisdiction, except where applicable law provides otherwise.
